Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the online resident portal and community website operated by Carriage Courts HOA ("the Association," "we," "us," or "our"). By accessing or using the portal, you agree to be bound by these Terms. If you do not agree, please do not use the portal.
These Terms apply to all residents, homeowners, authorized tenants, and any other individuals granted access to the portal ("you" or "User").
1. Use of the resident portal
Eligibility
Access to the resident portal is limited to current homeowners, authorized tenants, and individuals expressly granted access by the Association. Access is non-transferable and may be revoked at any time at the Association's discretion.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

The portal is provided solely for community management purposes, including paying dues, submitting maintenance requests, communicating with the Association, and accessing community information. Any other use is prohibited.

3. Dues, payments, and fees
Payment obligations
Use of the portal does not alter or supersede your obligations under the Association's governing documents, including the payment of HOA dues, assessments, and fees. All financial obligations remain subject to the CC&Rs, bylaws, and any applicable state law.
Online payments
If you make payments through the portal, you authorize the Association and its payment processor to charge the payment method you provide. You are responsible for ensuring your payment information is accurate and up to date. The Association is not responsible for failed payments due to incorrect or expired payment information.
Transaction records
Online payment confirmations are provided as a convenience. Official account records are maintained by the Association and may differ from portal displays in the event of a technical error. Please contact the Association to verify your account balance if you have any questions.
4. Community rules and governing documents
Your use of the portal and residence in the community are subject to the Association's governing documents, including the Declaration of Covenants, Conditions, and Restrictions (CC&Rs), bylaws, and any rules and regulations adopted by the Board. These Terms do not modify or replace those documents. In the event of a conflict, the governing documents shall control.
5. Content you submit
When you submit content through the portal — including maintenance requests, messages, photos, or form responses — you grant the Association a non-exclusive right to use that content for the purposes of managing your request or community matter. You represent that any content you submit is accurate and does not violate any law or third-party rights.
The Association reserves the right to remove or refuse any content it determines, in its sole discretion, to be inappropriate, inaccurate, or in violation of these Terms.
6. Availability and modifications
Service availability
The portal is provided through a third-party software provider and is made available on an "as is" and "as available" basis. The Association does not guarantee uninterrupted or error-free access. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability.
Modifications
The Association reserves the right to modify, suspend, or discontinue the portal or any of its features at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the portal.
7. Disclaimer of warranties
To the fullest extent permitted by law, the Association makes no warranties, express or implied, regarding the portal, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Information displayed in the portal is provided for convenience and may not reflect the most current Association records.
8. Limitation of liability
To the fullest extent permitted by applicable law, the Association, its board members, officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the portal, including but not limited to loss of data, failed transactions, or unauthorized access to your account.
In no event shall the Association's total liability to you exceed the amount of HOA dues paid by you in the three (3) months preceding the event giving rise to the claim.
9. Privacy and cookies
Your use of the portal is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the portal, you consent to the data practices described in those policies.
10. Third-party services
The portal is operated in part through a third-party software provider. The Association is not responsible for the acts or omissions of that provider, or for any downtime, data loss, or errors originating from their systems. Your use of any third-party services integrated into the portal is subject to those providers' own terms and policies.
11. Termination of access
The Association may suspend or terminate your portal access at any time, without notice, if you violate these Terms, if your residency or tenancy in the community ends, or for any other reason at the Association's discretion. Upon termination, your right to use the portal ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including sections on liability, disputes, and governing law.
12. Governing law and disputes
These Terms are governed by the laws of the State of INDIANA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in accordance with the Association's governing documents and applicable state HOA law. You agree to attempt to resolve disputes informally by contacting the Association before initiating any formal proceeding.
13. Changes to these terms
The Association may update these Terms from time to time. We will notify residents of material changes via the community website or email. Your continued use of the portal after the effective date of any update constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
